With the planned amendment to the Medical Cannabis Act, the Federal Ministry of Health (BMG) aims to undermine platforms for self-paying consumers. The draft law stipulates that cannabis can only be prescribed personally by a doctor and that mail-order sales are also prohibited .
In its statement, the ABDA welcomes the initiative to "curb abuse in the prescription and dispensing of medicinal cannabis." Both the restriction of telemedicine in this area and the ban on mail-order cannabis flowers are supported by the professional association.
The ABDA also proposes clarification regarding price control, arguing that medicinal cannabis has not lost its medicinal character with the new regulation under the Cannabis Act. The prescription requirement arises directly from Section 3 Paragraph 2 of the Medical Cannabis Act.
This special regulation on the pharmacy requirement thus overrides the more general regulation in Section 43 Paragraph 1 of the German Medicinal Products Act (AMG). However, the Drug Price Ordinance merely refers to the pharmacy requirement under the AMG regulation. The ABDA fears that this could lead to the argument that the AMPreisV does not apply to medicinal cannabis.
